OFFICIAL RULES RECORD STORE DAY/MY MORNING JACKET FLYAWAY SWEEPSTAKES

By entering or participating in the Record Store Day/My Morning Jacket FLYAWAY Sweepstakes (the "Sweepstakes") you agree to all of the following rules:
How to Enter. No purchase is necessary to enter the Sweepstakes. Anyone may register online at online registration at www.recordstoreday.com. Anyone may enter the Sweepstakes by mailing a 3" x 5" postcard with sufficient postage containing the sweepstakes name, Record Store Day/My Morning Jacket FLYAWAY Sweepstakes, which must be exact, your name, home address, telephone number, e-mail address and age to 1609 Baker Road, Raleigh, NC 27607. Any error or omission in the information on the card will void the entry. Limit one entry per individual per individual. Limit one entry per post card. By participating, all entrants agree to abide by these Official Rules.
Eligibility. The Sweepstakes is open to legal residents of the continental United States (other than Rhode Island) and the District of Columbia over the age of majority in their state of residence. Proof of age may be required. Employees of Music Monitor Network, Coalition of Independent Music Stores, Alliance of Independent Music Stores, Value Music Stores, Newbury Comics, employees of the coalition member stores, and employees of those retail outlets listed on www.recordstoreday.com and their affiliates, employees of any prize sponsor and its affiliates, and members of such employees' immediate families (their parents, spouses, siblings (natural born or adopted), children (natural born or adopted)) or households (“Ineligible Persons”) are ineligible to participate in the Sweepstakes.
Prize Deadlines. Participants may submit entries beginning at 12:00 A.M. Eastern (US) Daylight Time, April 1, 2008. All entries for the Sweepstakes must be received by 12:00 A.M. Eastern (US) Daylight Time, June 1, 2008. Winner will be selected from a random drawing, which will be held within seven (7) days after the deadline.
Winner Selection and Notification. The odds of winning are dependent upon the number of eligible entries received. All drawings will be conducted under the supervision of Music Monitor Network on June 5, 2008 at 5:00 P.M. Eastern (US) Daylight Time in Raleigh, North Carolina. The decisions of Music Monitor Network are final and binding in all matters relating to this Sweepstakes. Entries are the property of Music Monitor Network and will not be returned. Entrants need not be present at the drawing to win a prize. Winner will be notified by phone, e-mail or United States mail. If a winner cannot be reached after a reasonable effort has been made within five (5) business days of Music Monitor Network’s first attempt, or if an entrant is found to be ineligible, an alternate winner may be drawn.
Prizes. One Grand Prize Winner will receive roundtrip coach airfare for two to NYC from anywhere in the continental US, double bed hotel room accommodations for two nights, two tickets to the My Morning Jacket show on Friday, June 20 at Radio City Music Hall (no ground transportation covered), approximate retail value $2,000. Any applicable taxes shall be the sole responsibility of the winner. Any expenses not specifically included in the prizes (including ground transportation to and from airports and accommodations, all meals, and all other expenses incurred in connection with any trip) described in these rules shall be the sole responsibility of the winner.
General Conditions. This Sweepstakes is void where and to the extent prohibited by law and is subject to all applicable laws, including, without limitation, federal, state, provincial and local laws and regulations. In the event of non-compliance by any winner with the official rules of this Sweepstakes, an alternate winner may be selected. Prizes are non-transferable. Return of any prize or prize notification as undeliverable will result in a disqualification of the winner and an alternate winner may be selected. All prizes will be awarded. Except where legally prohibited, acceptance of any prize constitutes permission for Music Monitor Network to use each winner’s name, photograph, likeness, voice, address (city and state) and testimonials, in printed, broadcast or other media, whether now known or hereafter developed, in perpetuity, in any manner it deems appropriate in connection with promoting this or any other Sweepstakes and/or promotion sponsored by it, without further compensation to the winner.
Releases. By participating, entrants agree that Music Monitor Network, the Ineligible Persons, those involved in the development, production (including prize suppliers), implementation and distribution of this Sweepstakes and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (hereinafter collectively called "Released Parties"), shall not be liable for any claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Sweepstakes, including entry and participation in this Sweepstakes and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to such entrant’s participation in this Sweepstakes, such entrant will indemnify and hold Released Parties harmless from and against any and all such claims, including reasonable attorneys’ fees related thereto. Released Parties shall not be liable for entries that are delayed, lost, misdirected, misdelivered, incorrect or incomplete, and such entries will be not be eligible for this Sweepstakes. Released Parties shall not be responsible for any technical malfunctions of any telephone network, computer on-line system, computer equipment or software; program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or electronic; or any combination thereof, including, without limitation, any injury or damage to the computer of any entrant or any other person related to or resulting from downloading any part of this Sweepstakes. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law. Music Monitor Network reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should viruses, bugs or other causes beyond its control corrupt the proper administration or security of the Sweepstakes. Music Monitor Network reserves the right to modify the rules of the Sweepstakes in any way or at any time, as long as reasonable notice is given. All taxes on any prize won are the sole responsibility of each winner, including, without limitation, any federal, state, or local taxes which may be deemed applicable in such winner’s jurisdiction of residence. This Sweepstakes shall be governed by the laws of the State of North Carolina, United States of America. By participating in this contest, entrants agree that the state and federal courts located in the State of North Carolina shall have jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue for such litigation shall be only in the state or federal courts with jurisdiction in the city of Raleigh, North Carolina.
Rules/Winners List. To receive a copy of these Official Rules or the list of winners, send a self-addressed stamped envelope to: RECORD STORE DAY/MY MORNING JACKET FLYAWAY SWEEPSTAKES - Winners List, 1609 Baker Road, Raleigh, NC 27607. Specify "winners list" or "rules" on your request. WA, and VT residents may omit return postage. The promoter of this Sweepstakes is Music Monitor Network located at 1609 Baker Road, Raleigh, NC 27607.
Certain Prizes. For any prize awarded hereunder that involves a ticket, pass, boarding pass, back stage pass, VIP pass, access to a venue or access to an entertainer or entertainer group (collectively, a “ticket”), the ticket shall be a revocable license to the specific flight, event or location within the venue and for the time indicated to the prize winner by Music Monitor Network. Music Monitor Network reserves the right, without the award of any substitute prize or payment of any cash equivalent value, to refuse admission or to eject any person who fails to comply with the rules of the applicable airline or venue. No exchanges. The ticket user assumes all risks of personal injury incidental to the flight or event, whether occurring prior to, during, or subsequent to the flight or event, and holder voluntarily agrees that the Released Parties, airline, venue/facility, league or team, artist(s) performing, participants, participating clubs, and all of their respective agents, officers, directors, owners and employees are expressly released from any claims arising from such causes. The prize winner/user bears all risks of inclement weather, flight cancellation or delay. Tickets lost or stolen can not be replaced. Event time and date is subject to change. The resale or attempted resale of a ticket or any other prize is prohibited and if discovered will result in the ticket being voided without the award of any substitute prize, exchange or payment of any cash equivalent value. The ticket may not be used for advertising, promotion (including contests and sweepstakes) or other trade purposes without the express written consent of the Music Monitor Network.
